| Subject: | Proposed Legislation – Municipal Regulation of Fireworks |
| In the near future, I plan on introducing legislation that will give municipalities more authority to regulate the use of fireworks, along with penalties for violating those regulations. As you know Act 43 of 2017 allows consumers, 18 years of age or older, to purchase and use “Class C” or “consumer-grade” fireworks. Since the enactment of Act 43, my office has received numerous complaints regarding the legalization of consumer grade fireworks, as it has greatly disrupted the lives of many citizens across our state. As such, my proposal would allow a municipality to enact an ordinance providing for the conditions, prohibitions, and limitations on the use of consumer fireworks, provided that the ordinance does not conflict with State law. It also establishes times of day limitations on when fireworks can be used in order to minimize the disruption to residents of a community; limiting their use to between 10:00 AM to 9 PM Sunday through Thursday and 10 AM to 10 PM on Friday and Saturday, with extended hours for certain holidays. Additionally, my legislation would require notification, with each purchase of consumer fireworks, that provides the conditions, prohibitions, and limitations for the use of consumer fireworks. Finally, my proposed legislation will increase the penalties for individuals in violation of the municipal regulations. Please join me in cosponsoring this legislation.
