Subject: LEGISLATION: TRANSFER OF STATE HIGHWAYS ~ NEGOTIATION FLEXIBILITY FOR PENNDOT & MUNICIPALITIES
 
In the near future, I will be introducing legislation to afford PennDot and municipalities more flexibility when negotiating the terms for the transfer of state highways.

Currently, the Vehicle Code is silent on the ability of PennDot to move a portion of a state highway during the transfer of the road to a municipality. Furthermore, statute prohibits the transfer from occurring until after PennDot has fully completed any agreed-to rehabilitative work. These two(2) provisions can be problematic; sometimes its more expedient, safer and cost effective to move, rather than repair, portions of a state road and transfer to a municipality prior to rehabilitative work being completed. For this reason, my legislation would allow PennDot and municipalities to negotiate and mutually agree to a transfer date for any practical road re-locations.
