Subject: | Review of Regulatory Actions By The Independent Regulatory Review Commission |
Under the Regulatory Review Act (RRA), the commonwealth has a fair and impartial process for the promulgation of new regulations. Despite this fair process, state agencies have begun using regulatory actions (permits and policy guidelines) to achieve specific goals outside the regulatory process. These regulatory actions often impose significant burden on the regulated community and operate outside the impartial process enshrined into state law. In the near future, I plan to introduce legislation which would establish a process for the Independent Regulatory Review Commission (IRRC) to review regulatory actions. This process would have IRRC review whether the requirements of a regulatory action should have been submitted as a regulation under the RRA. After providing the agency time to provide information to the commission and soliciting comments from the regulated community, the Commission would make its determination. Should the commission determine that a regulatory action exceeds a state agency’s approved regulatory authority, the commission is required to provide a detailed explanation to the agency. Following this determination regulated entities will not have to comply with the requirements associated with the action unless they are approved by the commission as a separate regulation.
