Subject: Prohibiting Health Insurers from Denying or Excluding Coverage Based on a Pre-Existing Condition
 
Pennsylvanians denied insurance coverage because of pregnancy, cancer, illness, or any pre-existing condition. This is not a history lesson, but rather a brewing and potential crisis. A Federal Judge in Texas ruled that because Congress eliminated the individual mandate tax penalty of the ACA as part of tax reform legislation in December 2018, the entire ACA is invalid. This was not the final word and the ACA is still the law of the land.

However, if the lawsuit against the ACA is finally successful, millions of people across this nation and in Pennsylvania may be left without health insurance or face paying exorbitant premiums to keep coverage. We can preserve the pre-existing condition protection in the instance that the entire ACA is invalidated by the courts by passing a law. I strongly believe we should prohibit health insurers from using an individual’s pre-existing medical condition to deny or exclude coverage under a health insurance policy. Please join with me to protect the health and wellbeing of all Pennsylvanians.
