MEMORANDUM

Posted: February 6, 2019 10:37 AM
From: Representative Jack Rader, Jr.
To: All House members
Subject: NOT REQUIRING A POSITIVE DRUG TEST IN ORDER TO START ADDICTION TREATMENT

In the near future, I intend to introduce legislation to specify that a person does not need to test positive for drugs in order to begin addiction treatment.

The reason for this new law stems from an unfortunate circumstance in my legislative district where a young man seeking treatment had been clean, but he may have been required to test positive for drug use in order to commence treatment for his substance use disorder. He went out and used an opioid in an effort to provide a positive drug test and unfortunately suffered an overdose that killed him.

In order to avoid any similar confusion from ever happening to another person, my legislation will amend the Administrative Code to clarify that requiring a positive drug test in order to receive addiction treatment will be illegal here in Pennsylvania. I hope you will consider joining me in co-sponsorship of this needed revision to the law.
