Subject: E-Verify Legislation
 

The federal government has a voluntary program, known as the Employment Eligibility Verification Program, (E-Verify), to help employers determine whether prospective employees are unauthorized aliens. The program is operated jointly by the Department of Homeland Security and the Social Security Administration.

E-Verify is a free program and is the best means available for determining employment eligibility of new hires and the validity of their Social Security numbers.

In the near future I intend to introduce legislation to require all employers in the Commonwealth to use E-Verify. The legislation will do the following:
  • Employers in Pennsylvania shall verify employment eligibility of an employee using E-Verify.
  • On receipt of a complaint that an employer knowingly employs an illegal alien, the attorney general or district attorney shall investigate.
  • Penalties for violation of the act include permanent suspension of all state-issued licenses necessary to do business in the Commonwealth.
  • Random compliance audits will be initiated by the Department of Labor or any elected official in the Commonwealth.
While immigration reform is primarily a federal issue, Pennsylvania can and should be doing more to ensure that jobs in this Commonwealth are occupied by United States citizens and those who are residing here legally.
