MEMORANDUM

Posted: October 17, 2018 01:10 PM
From: Representative Carolyn T. Comitta
To: All House members
Subject: Eminent Domain for Public Utility Pipelines

Having a public utility corporation place a pipeline near or through a person’s land can be a stressful, intimidating, and devastating prospect. Unfortunately, for Pennsylvania families whose homes and land are in the path of these pipelines, they have little choice but to allow the pipelines to cut across their property.

My legislation will protect Pennsylvania families and provide oversight over the eminent domain process for public utility corporation pipelines. First, my bill prohibits petroleum or petroleum product transportation lines from being within 100 meters of a “dwelling house.” My bill would also require public utility corporations to first receive approval from the Pennsylvania Public Utility Commission before using eminent domain to obtain property for construction of a pipeline.

I ask for your support and to join me in co-sponsoring this legislation that provides oversight and protection for Pennsylvania families.

Introduced as HB2746
