Subject: Consumer Fireworks Legislation
 
As you may know (and probably, literally heard), this year the General Assembly greatly expanded the types of fireworks which can be legally sold to consumers. These include those which have a loud report and/or can be launched into the air.

This past 4th of July brought many complaints from citizens about fireworks being set off at all hours of the night, on property without permission of the owner, and dangerously close occupied structures. Temporary sales “tents” selling these more volatile items were set up, often without any license from the Department of Agriculture and often in gas stations where the risk of a catastrophic fire was greatly increased.

In an attempt to bring a measure of control to this new fireworks environment without spoiling the fun, I plan to introduce legislation which will provide some common sense regulation. Among other things, my bill will:
  • limit the hours and days fireworks can be set off;
  • Establish limits on where fireworks can be set off;
  • Prohibit sales and storage near flammable liquids;
  • Prohibit sales to minors;
  • Require proper licensing, security, insurance and minimum square footage of temporary sales facilities;
Depending on the violation, offenses will be graded as a summary offense or a misdemeanor of the second degree. The bill will permit police to seize fireworks from violators.
