Subject: Informed Consent Protection Act
 
In the near future, I intend to introduce legislation that will support parents in obtaining fair and equal access to medical treatment for their children regardless of their child’s vaccination status.

As I am sure you are aware, parents sometimes choose to exercise their legal right to delay or decline one or more vaccines for religious, philosophical, or medical reasons. These children are being denied medical care at pediatric offices, even when presenting with urgent medical issues or needing referrals for special needs speech/ physical therapies or needing physical exams to meet school attendance requirements.

In light of recent information, especially studies and reports indicating unintended harm from Gardasil HPV vaccines, it is vital to address this violation of basic rights.

My legislation will do the following:
  • A health care practitioner or facility will not be permitted to refuse to treat a child whose parent has chosen to delay or decline one or more vaccines.
  • A health care practitioner may not require a patient or guardian to sign a self-incriminating waiver as a condition for continuing to provide medical care.
  • A health care practitioner may not accept a financial incentive from an insurance or pharmaceutical company for vaccinating patients or for maintaining a certain rate of vaccinated patients within his or her medical practice.
The legislation also outlines a series of fines and penalties in the event that a health care practitioner does not comply with the legislation.

I believe this legislation addresses a serious problem in which some Pennsylvania children are being denied medical care. Please join me in cosponsoring this legislation.
