Subject: | Legislation Providing for Eligibility Requirements for Solar Energy Tax Credits |
In the near future, I plan to introduce legislation that would amend Act 213 of 2004, also known as the Alternative Energy Portfolio Standards Act, to provide for eligibility requirements for alternative energy sources in the Commonwealth. Specifically, this legislation would provide that in order to qualify as an alternative energy source under Act 213, a solar photovoltaic system would be required to directly deliver the electricity it generates to a retail customer, electric distribution system, or electric distribution company operating in the Commonwealth. Act 213 provides that electric distributors may purchase solar renewable energy credits (SRECs) from homeowners and businesses that have installed solar panels. However, out-of-state alternative energy systems may sell SRECs in the Commonwealth, thereby placing Pennsylvania-based solar energy systems at a competitive disadvantage. The legislation that I will be introducing would rectify this oversight by requiring SRECs to be purchased from within the Commonwealth, thereby eliminating the current competitive disadvantage and subsequently bolstering Pennsylvania’s solar energy production.
