Subject: Agricultural Lands Condemnation Approval Board Legislation
 
The Agricultural Lands Condemnation Approval Board (ALCAB) is a board which meets on an as-needed basis to review whether there are prudent and feasible alternatives to condemning agricultural land for certain highway purposes and certain disposal of solid or liquid waste material. The board has six members, four of which are agency secretaries (or their designees) and two of which are farmers, appointed by the Governor with the consent of the Senate. The farmer members do not have designees or alternates.

At the request of the agricultural community, I plan to introduce legislation which would require the Governor, with the consent of the Senate, to also appoint two alternate farmer members to the ALCAB. Alternate farmer members would only serve in the event of a vacancy or absence of the appointed farmer member, and when delegated by the board chairman to serve. While the ALCAB meets very infrequently, there may be situations where the appointed farmer member is not available and, rather than lose the perspective of the farmer member, an alternate would be beneficial.
