MEMORANDUM

Posted: May 12, 2017 04:16 PM
From: Representative Michael H. Schlossberg
To: All House members
Subject: Sexual Assault Bill of Rights Legislation & Providing for Termination of Parental Rights in cases of Rape or Incest

In the near future I will introduce legislation that will address two issues in current law, both related to challenges faced by victims of sexual assault. I hope that you will join me in co-sponsoring these important bills and help protect the rights of victims of sexual assault.

Document #1

Introduced as HB1682

Description: The first bill will address an issue related to parental rights. Current adoption law requires that when a parent of a child conceived by rape or incest seeks to terminate parental rights of the other parent, a third person must be willing to adopt the child.  My legislation would remove that requirement in the cases where the child is the product of rape or incest.

Document #2

Introduced as HB1683

Description: The second bill will require health care facilities to inform victims of their rights under the Sexual Assult Testing and Evidence Collection Act (Act 165 of 2006).  This proposal provides sexual assault victims and their families various rights not covered by the Crime Victims Act (Act 111 of 1998), including the right to disclosure of information about the submission of evidence, status of analysis, requests to compare DNA profiles recovered to DNA profiles stored in the national or state databases, and any discovery of matches from evidence submission.
