Upon our return, I plan to introduced language from HB353 that will amend Chapter 3 of Title 57 dealing with Notaries Public. Currently, a notary applicant must complete an exam and at least three hours of approved notary education within the six month period immediately preceding their application. Persons seeking their four year reappointment must complete continuing education, this includes a licensed attorney. As you may be aware, a licensed attorney’s education is far more extensive and the continuing legal education requirement for an attorney is far more rigorous. Many licensed attorney’s hold a notary license in order to provide convenience to their clients. In fact, New York currently exempts licensed attorneys from the exam and continuing education requirement. To eliminate this unnecessary burden, my legislation will exclude an attorney, who is licensed in this Commonwealth and is current on all required continuing legal education requirements, from the notary exam and continuing education requirement.
