Subject: Service Dog Legislation
In the near future I will be introducing legislation that would amend Title 18 (Crimes and Offenses) providing for the offense of misrepresentation as service animal.

It is becoming a large problem with people misrepresenting their animals as service animals. It is now documented where we have untrained animals attacking Seeing Eye dogs and airline employees. It has also become much more difficult for stores, etc. to determine which animals they can and cannot allow into their establishments.

Under this legislation, an individual commits an offense of misrepresentation as service animal if they knowingly:
  • Create a document that misrepresents an animal as a service animal;
  • Provide documents to another person falsely stating that an animal is a service animal;
  • Fits an animal, when the animal is not a service animal, with a harness, collar, vest or sign of the type commonly used by a person with a disability to indicate an animal is a service animal; or
  • Represents that an animal is a service animal when the animal has not completed training to perform disability-related tasks or disability-related work for a person with a disability.
Under my legislation, a person who violates this section commits a summary offense and shall, upon conviction, be sentenced to pay a fine not to exceed $1,000.
