Subject: Indecent Exposure
 
In the near future, I will introduce legislation directing the Pennsylvania Commission on Sentencing to provide for a sentence enhancement for committing the offense of indecent exposure when children are present.

The need for a sentence enhancement was brought to me by a constituent. A neighbor of the constituent committed the offense of indecent exposure while the constituent’s minor daughter was present. This was his second offense. An offense of this nature should warrant jail time when children are present.

Accordingly, my legislation will require a sentence enhancement for the offense of indecent exposure when children under 16 are present. The sentence enhancement will provide for ranges of sentences applicable based upon aggravating circumstances such as: (1) the number of persons under 16 years of age who are present; (2) the age of each person present who is under 16; and (3) the nature and character of the indecent exposure.
