Subject: | Act 162, amending the Clean Streams Law |
In 2014, the General Assembly passed Act 162, amending the Clean Streams Law, providing alternative compliance options for earth disturbance projects. More specifically, this bipartisan law allows developers to use a variety of best management practices to maintain stream quality aside from traditional riparian buffers. However, certain projects like road construction were eligible for waivers from the stream buffer requirements. Unfortunately, Act 162 has since been interpreted to eliminate the DEP waivers for these various development activities. Accordingly, in the near future I will introduce legislation clarifying Act 162 to restore the riparian buffer waiver process. Act 162 has always been intended to provide more flexibility and more choices in protecting water quality. My legislation will further ensure this goal.
