Subject: Fostering Free Enterprise Eco-systems/State-owned University Intellectual Property Act
 
On Wednesday, May 18, I plan to introduce legislation to foster the development of free enterprise eco-systems among state-owned (PASSHE) universities, PASSHE employees and the private sector. The intent is to advance research and to commercialize intellectual property.

Following the enactment of Act 132 of 2012, legislation I am pleased to have helped champion, PASSHE employees have been granted greater opportunities to develop, commercialize and market new products and services related to intellectual property. That’s the good news!

The less-than-good-news, though, is that PASSHE stakeholders have identified barriers which restrict its universities, faculty, staff, and students from fully realizing all of the entrepreneurial freedoms intended by Act 132. This legislation will remove some of these obstacles by repealing those provisions of the Public Official and Employee Ethics Act (which limits contracts between public employees and governmental bodies) which are blocking engagement in the legitimate activities authorized by the legislature via Act 132.

Allowing for the full implementation of the potential inherent in Act 132 will situate PASSHE universities, employees and students on regulatory par with other categories of universities. I hope you will join me in supporting the development of free enterprise eco-systems in this Commonwealth by co-sponsoring this legislation.
