Subject: | Former HB 2379 - Amending the Municipality Authorities Act on Competitive Enterprises |
In the near future, I will introduce legislation to amend the Municipality Authorities Act. This legislation will provide that if a water or sanitary sewer authority is providing federal or state mandated testing services to another authority, these testing procedures on behalf of another authority shall be considered a prohibited competitive enterprise if an existing private business charging competitive rates is qualified to perform the testing procedures and is located within the service area of either authority. A water or sanitary sewer authority could continue to perform its own testing services. Currently, the Municipality Authorities Act provides that an authority should not unnecessarily burden or interfere with existing business by establishing competitive enterprises. This non-compete clause is ambiguous and this bill will provide needed clarity. Please join me in cosponsoring this legislation. (Former cosponsors: GODSHALL and GINGRICH) |
