Subject: | Protecting Patient Access to Diabetic Shoes |
CO-SPONSORSHIP MEMORANDUM In the near future, I am introducing legislation that will amend section 13.5 of the Medical Practice Act of 1985. There is an unintentional situation that is impending with regards to diabetic shoe fitters. As of July 2014 pharmacies and durable medical equipment (DME) providers will be prevented from selling diabetic shoes unless sellers are certified specifically as licensed orthotic fitters. Therefore, many people will no longer have the ability to do a job they have been doing successfully and professionally for years. DME providers and pharmacies currently account for nearly 95 percent of sales of these devices and if this is not addressed, patients in PA will be limited to getting their diabetic shoes from a small number of licensed pedorthists spread across the state, resulting in restricted access to care. My legislation will amend the existing law to, essentially, remove diabetic shoes and inserts from requiring licensure. This will allow pharmacies and DME providers to continue to dispense diabetic shoes and inserts without going through extensive licensure qualifications.
