|Subject:||Restriction of Prior Offense Questions in Employment|
|I will soon be introducing legislation that would greatly restrict the circumstances under which a prospective employer may use questions about prior arrests, convictions or adjudications on employment application forms. Our existing law was intended to be protective of applicants' rights, but has gone astray. Too many employers are now using blanket disqualifying questions on their applications, regardless of the nature or relevance of the offense in question. This is creating a large class of essentially unemployable people who eventually become dependent on public resources for survival and basic sustenance. This is not sustainable fiscally.
By returning to the prior understanding, that such prior offenses are only to be considered where they are relevant to the position being sought, we can make more people who have had minor prior run-ins with the criminal justice system more employable in more positions, and less of a burden to the taxpayers. We all would come out ahead. Please consider cosponsoring this important legislation. We can't afford to build a bigger and bigger permanent underclass this way.
