MEMORANDUM

Posted: June 24, 2013 03:46 PM
From: Representative Thaddeus Kirkland
To: All House members
Subject: Co-Sponsorship: KIRKLAND-Expungement of Criminal Records

In the near future, I plan to introduce legislation that will help individuals seeking expungement of their criminal history as a minor.

To be eligible to have a criminal conviction expunged under this legislation, the individual cannot be convicted of a sexual crime, violent crime, a crime that endangers the public, or a crime that carries a punishment of life imprisonment. Also, at least 18 months must have passed since the individual has been released from the jurisdiction of the court, and the individual cannot have convictions as an adult of any misdemeanor or felony other than a minor traffic violation. In addition, this legislation protects the individual from self-incrimination by those familiar with his or her expunged offenses. Under this legislation, an individual may only have one conviction expunged.

When an individual shows through character and reputation their dedication to a responsible life as an adult, this legislation will help them maintain their freedom, allowing individuals who have grown responsibly into adulthood to succeed in life without the burden of a mistake from their past.
