Subject: | Amending the Purely Public Charities Act |
We intend to re-introduce House Bill 928 of this session amending Section 5 of the Institutions of Purely Public Charities Act. This bill is a companion bill to that being introduced by Senator Vogel and Senator Schwank. The bill will extend the act to include fraternal organizations operating under the lodge, council, or grange system that qualify for exemption from taxation under specific 501(c) sections of the Internal Revenue code and have been operating in the Commonwealth for at least 100 years. These organizations are historically charitable, dedicating themselves to the betterment of their communities through service, education, and fellowship. Currently, there are a number of Grange and Masonic Lodge locations that have applied for and are given charitable status, removing them from certain tax liability. More specific references to Grange and Masonic Lodge locations are being added to provide more clarity and remove errors of interpretation that result in an unequal tax status of organizations across the state on a county by county basis. This legislation will be introduced by May 17, 2013.
