Subject: | Re-Introduction of Legislation Establishing Operating Rules for a Motorized Bicycle |
In the near future, I intend to re-introduce legislation (former HB 2216 of 2011-2012 legislative session) that addresses the problems e-bike users are facing due to police handing out tickets for not having a license plate on their bicycle. Under current Pennsylvania state law, users cannot obtain a license plate for a bicycle, because the bicycle does not have a VIN number. My legislation would amend Title 75 (Vehicles) of the Pennsylvania Consolidated Statutes to define a bicycle under section 102 (Definitions) and establish section 3591 (Operating a motorized bicycle) under Chapter 35 (Special Vehicles and Pedestrians), outlining the special rules for bicycles. It is important to address the problems e-bike users are having. My proposal mirrors that of Florida’s current law, which defines a bicycle in their Uniform Traffic Control Law as any vehicle propelled solely by human power, and every motorized bicycle propelled by a combination of human power and an electric helper motor.
