Subject: Tenants Rights to Foreclosure Notices (Former HB 1764 of 2011) and Notice of Foreclosure (Former House Bill 1846 of 2011)
 
These bills will require landlords to provide a certified copy of foreclosure notices to tenants under threat of foreclosure and tenants' right to disclosure.

Description: In the near future, I intend to reintroduce legislation known as the Landlord and Tenant Act of 1951, providing for tenants' right to disclosure.  As you may recall, this proposal was introduced last session as House Bill 1764, Printer’s Number 2265.
 
My proposal inserts a new article, Tenants’ Right to Disclosure, into the Act of April 6, 1951 (P.L. 69, No. 20), otherwise known as the Landlord and Tennant Act, which compels landlords to provide fixed-term tenants with a certified copy of a foreclosure notice at least 60 days prior to the termination date specified in the notification.  In addition, month-to-month and week-to-week tenants are also be protected under this legislation.  Specifically, my bill requires landlords to provide these tenants with certified documentation at least 30 days prior to the termination date. 
 
Currently, landlords are not required to provide notice to tenants when a foreclosure notice has been delivered to the property owner.  As a result, tenants are then forced to remove their personal property and relocate to a new residence at the time of the foreclosure without proper notice to make arrangements.  This experience can be extremely devastating for individuals and families.  As members of the General Assembly, it is our duty to continue to protect the residents of this great Commonwealth and ensure that Pennsylvania continues to be a great place to live. Accordingly, please join me in protecting renters from undue hardship.

As you may recall, this legislation was introduced as House Bill 1846, Printer’s Number 2369, in the 2011-12 Legislative Session.

My proposal inserts a new section, Section 302.1 (Notice of Foreclosure), into the Act of April 6, 1951 (P.L. 69, No. 20), otherwise known as the Landlord and Tenant Act, which compels landlords to provide written notice to all tenants of the property if they receive notification of foreclosure. The notification provided must be given at least 90 days prior to the sale of the property.

Currently, landlords are not required to inform tenants when a foreclosure notice has been delivered to the property owner. Without timely notification, tenants are forced to abruptly remove their personal possessions and relocate to a new residence. Such an experience can be extremely devastating for individuals and families, especially children. As members of the General Assembly, it is our duty to continue to protect the residents of this great Commonwealth and assure that Pennsylvania continues to be a great place to live.
