Subject: | Allows Windmills on Farmland Preservation |
Currently, the Agricultural Easement Program does not prevent the granting of rights-of-ways (after preservation) for the installation of, transportation of, or use of water, sewage, electric, telephone, coal or non-coal minerals by underground mining methods, gas, oil or oil products lines. My legislation, which is attached for your purview, will add the ability for a preserved farmland owner to grant a right-of-way to install a wind power generation system, with limitations on the amount of preserved acreage that can be used for such a system by amending the Agricultural Area Security Law. Former (HB 2228) contained similar provisions; however this proposal includes limitations that will help safeguard the integrity of the preserved farmland.
