Subject: | Co-Sponsor – Legislation Amending the Local Tax Enabling Act |
In the near future, I plan on introducing legislation amending the Local Tax Enabling Act (Act 511 of 1965) to provide for Advisory Tax Collection Committees. Specifically, my legislation creates a new subsection that permits Advisory Tax Collection Committees in counties when there is only one school district and each municipality contracts with the same countywide office for the collection of earned income taxes. Under these circumstances, municipalities may continue to collect their taxes through the countywide office and may form an Advisory Tax Collection Committee in lieu of a tax collection committee. At this writing, only Lancaster and Philadelphia counties are authorized to do this. An Advisory Tax Collection Committee would be required to meet once annually to review legal and audit matters, to provide recommendations and concerns to the countywide office and to provide staff for the appeals board. Current Pennsylvania law gives existing tax collection committees an inordinate amount of control to small entities in counties with one school district; my legislation changes that.
