MEMORANDUM

Posted: February 14, 2013 02:18 PM
From: Representative Jaret Gibbons
To: All House members
Subject: Mandating Chemical Sample Tests of Drivers Involved in Certain Accidents

In the near future, I plan to introduce legislation that will amend Title 75 (Vehicles) of the Pennsylvania Consolidated Statutes by requiring law enforcement officials to obtain a chemical test sample for any driver of a vehicle involved in an accident resulting in serious bodily injury or death of any individual.

Irresponsible individuals that get behind the wheel of a vehicle after consuming alcohol or controlled substances are not only putting their own lives in danger but also all those innocent individuals within their path. In Pennsylvania, specific provisions have been established that penalize those individuals that drive a vehicle while under the influence; however, law enforcement officials cannot fully penalize these offenders since motorists involved in a vehicular accident involving serious injury or death are not mandated to submit to a chemical test sample.

In order to address this issue, my legislation will require law enforcement officials to obtain a chemical test sample from any driver of a vehicle involved in an accident resulting in serious bodily injury or death of any person. Moreover, my legislation requires that the medical personnel that administer the test must immediately provide the results to law enforcement officials.

Please join me in ensuring that any driver who ruins the lives of other motorists and their families is properly penalized for their selfish and reckless behavior. Similar laws have already been enacted in Arizona, California, Colorado, Connecticut, Delaware, Florida, Hawaii, Idaho, Illinois, Maine, Missouri, New Hampshire, New Jersey, North Dakota, Ohio, South Dakota, and Wisconsin.
