MEMORANDUM

Posted: February 1, 2013 11:29 AM
From: Representative Angel Cruz
To: All House members
Subject: Court-Ordered Community Service in Lieu of Vehicle Code Fines and Costs (Former HB 1204)

In the near future, I plan to reintroduce House Bill 1204 of the 2011-2012 Legislative Session, which amends Title 75 (Vehicles) of the Pennsylvania Consolidated Statutes and permits individuals to complete community service in lieu of up to 50% of the fines imposed for Vehicle Code violations.

During these challenging economic times, it has become difficult for individuals to pay fines and costs that have been imposed under the Vehicle Code. In order to assist these individuals that do not have the financial means to pay such fines and costs, I will be introducing legislation to amend 75 Pa.C.S. §6504, which will authorize the courts to order community service be performed by these individuals. While I believe it is important that we provide individuals with the opportunity to utilize the limited income they have to provide necessities to their families, I do believe the individuals must be penalized for violating established laws in Pennsylvania. It is for this reason that my legislation will require that the court-ordered community service be completed in lieu of payment of up to only 50% of the imposed fines and costs.

Please join me in ensuring that individuals that are financially struggling are provided with an opportunity to pay for a portion of their fines with providing service to our communities.
