In the coming weeks, I will be re-introducing former House Bill 1710 further providing for child support guidelines. It was recently brought to my attention that there is a defective problem with the current Pennsylvania Child Support Guidelines. Under current law, the surviving non-custodial biological parent benefits from the other parent’s death. Given that a minor child has lost a parent, it should be the minor child that receives benefits. Prior to the custodial parent’s death, the non-custodial parent would owe child support. The death of the custodial parent should not change this. Under my legislation, if a child for whom support is sought is receiving Social Security benefits as a result of the death, retirement or disability of anyone other than the obligor, then the obligor would not receive a credit for these benefits against his or her child support obligation.
