Subject: Pool Fencing - Formerly HB 465
 
In the near future, I plan to re-introduce legislation to amend the Pennsylvania Construction Code Act (Act 45 of 1999) to clarify the law in regards to the Uniform Construction Code (UCC) requirements for pools and spas. My legislation would make the law clear that a pool/spa could not be filled with water until all barrier/miscellaneous requirements of the UCC are met. The UCC has specific requirements for electrical/plumbing hookups and barrier construction; however, although inferred, the UCC does not clearly state that such requirements must be met before pools/spas are filled with water.

My legislation is the result of an unfortunate incident in my district where a child drowned in a neighbor’s pool that was not fenced. I have met with a pool contractor and I believe this legislation is reasonable and will not cause the public or contractors undue hardship.
