MEMORANDUM

Posted: January 13, 2013 02:02 PM

To: All House members
Subject: Mileage Reimbursement for Witnesses (Former HB 543)

I am reintroducing legislation which will increase the mileage reimbursement rate for witnesses subpoenaed to testify before any government unit (except the minor judiciary) or before the Philadelphia Municipal Court. Currently, the Judicial Code provides that every witness shall be paid mileage at the rate of $.07 for each circular mile travelled between the location named in the subpoena and the residence of the witness.

My legislation will amend the Judicial Code to increase the travel reimbursement from $.07 per mile to the business standard mileage rate established by the Internal Revenue Service for deductible business mileage expenses. Given the state of the economy, coupled with the rising cost of gas and the fact that the mileage rate for witnesses has not been adjusted since 1978, it is absolutely essential that the rate be increased to comport with current standards. This proposed legislation will reduce the financial burden imposed upon witnesses who are compelled through the issuance of a subpoena to travel to various locations throughout the state to provide testimony before our government units. Moreover, the tie-in with the IRS rate allows for periodic increases without the need for the General Assembly to continually.
