CONVEYANCE - COMMONWEALTH PROPERTY IN MONTOUR COUNTY Act of Nov. 23, 1982, P.L. 692, No. 199 Cl. 85 AN ACT Authorizing and directing the Department of General Services and the Pennsylvania Department of Agriculture, with the approval of the Governor, to convey to the Danville Area School District, 11.80 acres of land, more or less, situate in the Borough of Danville, Montour County, Commonwealth of Pennsylvania. The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: Section 1. The Department of General Services and the Pennsylvania Department of Agriculture, with the approval of the Governor, are hereby authorized and directed on behalf of the Commonwealth of Pennsylvania to grant and convey for a consideration of one-half of fair market value to the Danville Area School District, described in accordance with a plan prepared for the Danville Area School District, dated January 1982, as prepared by Peter J. Uhle, Registered Surveyor, 708 East Front Street, Danville, Pennsylvania and the following tract of land situate in the Danville Area School District, Montour County, and Commonwealth of Pennsylvania, bounded and described as follows: Beginning at a concrete monument, said monument being the southeast corner of the described tract of land and also being the northeast corner of lands of the cemetery; thence along lands of the cemetery north 80 degrees 38 minutes west 607.37 feet to a concrete monument; thence along lands of the Danville Area School District north 09 degrees 13 minutes east 850.64 feet to an iron pin; thence along United States Route 11 south 83 degrees 42 minutes east 465.93 feet to an iron pin; thence along lands of the grantor south 56 degrees 45 minutes east 136.88 feet to an iron pin; thence along the same south 07 degrees 32 minutes west 125.25 feet to an iron pin; thence along the same south 08 degrees 02 minutes west 692.96 feet to the place of beginning. Containing 11.80 acres. The conveyance shall be made under and subject to all easements, servitudes and rights of others, including but not confined to streets, roadways and rights of any telephone, telegraph, water, electric, sewer, gas or pipeline companies, as well as under and subject to any interest, estates or tenancies vested in third persons, whether or not appearing of record, for any portion of the land or improvements erected thereon. Section 2. The purchase price of one-half of fair market value shall be paid to the Commonwealth over a 3-year period in equal annual installments commencing on January 15 of the year following the effective date of this act and each year thereafter. Section 3. The deed of conveyance shall contain a clause that the lands conveyed shall be used for scholastic and recreational purposes by the Danville Area School District and if at any time the said Danville Area School District or its successor in function conveys said property or permits said property to be used for any purpose other than those aforementioned, the title thereto shall immediately revert to and revest in the Commonwealth of Pennsylvania. Section 4. The deed of conveyance shall be approved as provided by law and shall be executed by the Secretary of General Services in the name of the Commonwealth of Pennsylvania. Section 5. Costs and fees incidental to this conveyance shall be borne by the grantee. Section 6. This act shall take effect immediately.
