AN ACT
Amending the act of March 3, 1978 (P.L.6, No.3), entitled "An
act to promote the general welfare and stimulate the economy
of the Commonwealth by requiring that all public bodies,
including the Commonwealth, its political subdivisions, and
all authorities, include in all contracts for construction,
reconstruction, alteration, repair, improvement or
maintenance of improvements of a permanent or temporary
nature, a provision that if any steel products are to be used
in the performance of the contract only steel products
produced in the United States shall be used, and imposing
liability for violation of this act," further providing for
payments under contracts by requiring centralized portal for
electronic submission of documentation.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 5 of the act of March 3, 1978 (P.L.6,
No.3), known as the Steel Products Procurement Act, is amended
by adding a subsection to read:

(a.1) A public agency shall create a centralized portal to

electronic submission of the documentation required under
subsection (a). A person under a contract containing the
(2) THE FOLLOWING MAY UTILIZE A CENTRALIZED PORTAL TO
ALLOW FOR THE ELECTRONIC SUBMISSION OF THE DOCUMENTATION
REQUIRED UNDER SUBSECTION (A):
(I) COUNTIES, CITIES, BOROUGHS, TOWNSHIPS, SCHOOL
DISTRICTS AND ANY OTHER GOVERNMENTAL UNIT OR DISTRICT.
(II) ALL MUNICIPAL OR SCHOOL OR OTHER AUTHORITIES
NOW IN EXISTENCE OR HEREAFTER CREATED OR ORGANIZED BY ANY
COUNTY, CITY, BOROUGH, TOWNSHIP OR SCHOOL DISTRICT OR
COMBINATION THEREOF.
(3) A PERSON UNDER A CONTRACT CONTAINING THE provision
required by section 4 may submit the documentation required
under subsection (a) EITHER to the centralized portal OR IN
ACCORDANCE WITH THE CONTRACT when the person obtains the
unidentified steel products under the contract. After the
initial submission of the documentation required under
subsection (a) , the person under the contract may use the
unidentifiable steel products in future projects if the
person submits a certification to the public agency that the
person previously submitted the documentation required under
subsection (a) for the steel products. FOR UNIDENTIFIED STEEL
PRODUCTS SUPPLIED UNDER THE CONTRACT, THOSE UNIDENTIFIABLE
STEEL PRODUCTS MAY CONTINUE TO BE USED ON THE CONTRACT
WITHOUT RESUBMITTING THE DOCUMENTATION.

Section 2. This act shall take effect in 60 days.
