AN ACT
Amending Title 64 (Public Authorities and Quasi-Public
Corporations) of the Pennsylvania Consolidated Statutes, in
Commonwealth Financing Authority, providing for Economic
Recovery Grant Program; imposing a duty to report to the
General Assembly; and making an appropriation.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 64 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 1559. Economic Recovery Grant Program.
(a) Establishment.--The Economic Recovery Grant Program is
established and shall be administered by the authority.
(b) Purpose.--The program shall provide financial assistance
in the form of grants to eligible applicants in accordance with
this section.
(c) Eligibility.--An applicant shall be eligible for a grant
under the program if the applicant was approved MET MINIMUM
ELIGIBILITY REQUIREMENTS for a grant for a project under the
Redevelopment Assistance Capital Program, the Industrial Sites

Reuse Program or Business in Our Sites in 2019 or 2020 2019,
2020 OR 2021 but the project was not funded or not fully funded.
(d) Application.--An eligible applicant may submit an
application to the authority requesting a grant under the
program. The application must be on the form required by the
board and must include or demonstrate all of the following:
(1) The name, address, telephone number and other
contact information of the applicant.
(2) Eligibility for a grant under the program, including
the previously approved application for the Redevelopment
Assistance Capital Program, the Industrial Sites Reuse
Program or Business in Our Sites.
(3) A statement of the type and amount of the grant
sought under the program as a result of the project under
subsection (c) not being funded or not being fully funded.
(4) Any other information required by the board.
(e) Review and approval.-- The authority shall determine
whether to approve the application under this section and the
amount of the grant awarded.
(f) Limitation.--Grants shall be awarded geographically on a
first-come, first-served basis until the money under subsection
(h) is exhausted.
(g) Report to General Assembly.--
(1) No later than one year after all the appropriated
money under subsection (h) is exhausted, the authority shall
submit a report to the General Assembly that includes the
following:
(i) A list of all of the recipients of grants under
the program.
(ii) The amount of the grants awarded under the

program.
(iii) A description of the projects for which grants
were awarded under the program.
(2) The authority shall post a copy of the report on the
publicly accessible Internet website of the authority.
(h) Appropriation .--In addition to any other money
appropriated to the authority for grants under this section, the
sum of $75,000,000 is appropriated to the authority from money
received by the Commonwealth under Title IX, Subtitle M, section
9901 of the American Rescue Plan Act of 2021 (Public Law 117-2,
135 Stat. 4) and deposited into the COVID-19 Response Restricted
Account for the purpose of making grants under this section.
(i) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Eligible applicant." An applicant that satisfies the
requirements under subsection (c).
"Program." The Economic Recovery Grant Program established
under this section.
(j) Expiration.--This section shall expire upon the
submittal of the report under subsection (g).
Section 2. This act shall take effect in 180 days.
