AN ACT
Amending Title 71 (State Government) of the Pennsylvania
Consolidated Statutes, in preliminary provisions relating to
retirement for State employees and officers, further
providing for definitions.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The definition of "enforcement officer" in
section 5102 of Title 71 of the Pennsylvania Consolidated
Statutes is amended by adding a paragraph to read:
§ 5102. Definitions.
The following words and phrases as used in this part, unless
a different meaning is plainly required by the context, shall
have the following meanings:

(7) Commissioned police officers employed by the
Department of Corrections, Bureau of Investigations and
Intelligence.

Section 2. Notwithstanding 71 Pa.C.S. §§ 5507 and 5508, for
purposes of 71 Pa.C.S. § 5508(c)(4), any change in the accrued
liability that results from the addition of paragraph (7) to the
definition of "enforcement officer" in 71 Pa.C.S. § 5102 shall
be funded in equal dollar installments as a percentage of
compensation of all affected active members and active
participants employed by the Department of Corrections, Bureau
of Investigations and Intelligence over a period of 10 years
from the first day of July following the valuation date
coincident with or next following the effective date of this
section.
Section 3. The provisions of this act are severable. If any
provision of this act or its application to any person or
circumstance is held invalid, the invalidity should not affect
other provisions or applications of this act which can be given
effect without the invalid provision or application.
Section 4. The addition of paragraph (7) of the definition
of "enforcement officer" in 71 Pa.C.S. § 5102 shall apply
retroactively to any current employee of the Department of
Corrections, Bureau of Investigations and Intelligence, who
first became a member of the State Employees' Retirement System
on or before December 31, 2018. For those current employees of
the Department of Corrections, Bureau of Investigations and
Intelligence, who first became a member of the State Employees'
Retirement System on or after January 1, 2019, paragraph (7)
shall apply as of the effective date of this section and shall
not apply retroactively.
Section 5. This act shall take effect in 60 days.
