county under the jurisdiction of the department in the
implementation of the Commonwealth's COVID-19 Interim
Vaccination Plan. A pharmacy under this section must have been
approved as a COVID-19 vaccine provider and employ a certified
immunizing pharmacist.
(b) Exception.--If a county under the jurisdiction of the
department cannot comply with the requirements of subsection
(a), the department shall include any local pharmacy in a county
under subsection (a).
(c) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"COVID-19." The novel coronavirus as identified in the
Governor's proclamation of disaster emergency issued on March 6,
2020, published at 50 Pa.B. 1644 (March 21, 2020).
"COVID-19 Interim Vaccination Plan." Version 8.0 of the
Commonwealth's COVID-19 Interim Vaccination Plan published March
31, 2021.
"COVID-19 vaccine." A vaccine for COVID-19 that has received
emergency use authorization from the United States Food and Drug
Administration.
"Department." The Department of Health of the Commonwealth.
"Local pharmacy." A pharmacy, as defined under section 2(12)
of the act of September 27, 1961 (P.L.1700, No.699), known as
the Pharmacy Act, that is independent and solely owned and
operated in this Commonwealth. The term does not include a
retail chain pharmacy.
"Provider." A COVID-19 vaccine provider approved by the
Department of Health to distribute and administer COVID-19
vaccine doses in this Commonwealth.
