AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," providing for Kinesthetic Learning
Platform Pilot Program.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding an
article to read:
ARTICLE XV-K
KINESTHETIC LEARNING PLATFORM PILOT PROGRAM
Section 1501-K. Definitions.
The following words and phrases when used in this article
shall have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Department." The Department of Education of the
Commonwealth.
"Head Start." A program funded under the Federal Head Start

Act (Public Law 97-35, 42 U.S.C. ยง 9831 et seq.) and carried out
by a Head Start agency or delegate agency that provides ongoing
comprehensive child development services.
"Integrated kinesthetic learning platform." Educational
programming that incorporates developmentally appropriate
physical activity into existing academic settings.
"Program." The Kinesthetic Learning Platform Pilot Program
established under section 1502-K(a).
"School." A public or nonpublic prekindergarten,
kindergarten or elementary school in this Commonwealth.
Section 1502-K. Kinesthetic Learning Platform Pilot Program.
(a) Establishment.--The Kinesthetic Learning Platform Pilot
Program is established for the purpose of setting up and
administering a pilot program to provide integrated kinesthetic
learning platforms to schools for students in prekindergarten
through second grade.
(b) Duties of department.--The department shall select an
integrated kinesthetic learning platform that meets the
following minimum qualifications:
(1) Uses physical activity to improve academic
performance and teach according to objective academic
standards in English language arts and mathematics for
prekindergarten through second grade.
(2) Provides educators with simple and automated
correlation between national and State standards, including
Pennsylvania academic standards in English language arts and
mathematics for kindergarten through second grade learners
and Head Start standards for prekindergarten learners.
(3) Cost to a school does not exceed $1,500 per academic
year.

(4) Functions as a flexible supplemental resource to
standards-based content, serving as a method of introduction,
review and assessment.
(5) Provides opportunities for differentiated learning
by students of all learning styles and preferences.
(6) Allows educators, administrators and parents or
guardians to track the use of the platform.
(7) Allows for at-home use by students under proper
adult supervision.
(8) Provides supplemental written materials that
educators can assign to students to supplement lessons.
(9) Is available on-demand and offers dynamic content
rather than static lessons.
(c) Application.--Schools seeking to administer the program
shall complete an application to be established by the
department.
(d) Allocation.--
(1) No less than $250,000 from money appropriated to the
department shall be allocated annually for the program.
(2) Paragraph (1) shall not apply during a fiscal year
in which there is an appropriation to the department for the
sole purpose of the program.
Section 1503-K. Reporting.
(a) Report to department.--A school selected to administer
the application shall submit a report to the department no later
than 60 days after the end of an academic year. The report shall
include:
(1) A list of all expenses incurred by the program.
(2) The number of students who participated in the
program.

(3) A survey of the educators administering the program.
(4) Any other information requested by the department.
(b) Report to General Assembly.--The department shall
compile a Statewide report based on the information submitted
under subsection (a) and submit a report no later than December
31 of each year to the chairperson and minority chairperson of
the Appropriations Committee of the Senate, the chairperson and
minority chairperson of the Appropriations Committee of the
House of Representatives, the chairperson and minority
chairperson of the Education Committee of the Senate and the
chairperson and minority chairperson of the Education Committee
of the House of Representatives.
Section 2. This act shall take effect in 60 days.
