AN ACT
Amending Titles 18 (Crimes and Offenses) and 42 (Judiciary and
Judicial Procedure) of the Pennsylvania Consolidated
Statutes, in general provisions, further providing for
definitions; and, in particular rights and immunities,
further providing for death action.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 103 of Title 18 of the Pennsylvania
Consolidated Statutes is amended by adding a definition to read:
§ 103. Definitions.
Subject to additional definitions contained in subsequent
provisions of this title which are applicable to specific
provisions of this part, the following words and phrases when
used in this title shall have, unless the context clearly
indicates otherwise, the meanings given to them in this section:

"Person." Any individual, corporation, partnership, limited
liability company, business trust, other association, government

entity, not including the Commonwealth, estate, trust or
foundation. The term shall include an unborn child as defined in
section 3203 (relating to definitions).

Section 2. Section 8301 of Title 42 is amended by adding a
subsection to read:
§ 8301. Death action.

(e) Definition.--As used in this section, the term
"individual" means a human being, including an individual
organism of the species homo sapiens from fertilization until
live birth.
Section 3. This act shall take effect in 60 days.
