AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in the State System of Higher
Education, providing for equalization of appropriations.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 2022-A. Equalization of Appropriations.--(a) The
Secretary of the Budget shall annually calculate the difference
between the following:
(1) The total amount appropriated to the system for
education and general support.
(2) The total amount appropriated to the State-related
institutions for education and general support.
(b) (1) If the total amount appropriated to the system for

education and general support is less than the total amount
appropriated to the State-related institutions for education and
general support, the Secretary of the Budget shall certify the
amount of the difference and publish the amount in the
Pennsylvania Bulletin.
(2) If any subsequent acts affect the certified amount
calculated under this subsection, the Secretary of the Budget
shall recertify the amount as may be necessary.
(c) Each fiscal year, if the total amount appropriated to
the system is less than the total amount appropriated to the
State-related institutions and a certified amount is published
under subsection (b), the certified amount shall be transferred
to the system.
(d) Any amounts required to be transferred to the system in
accordance with this section are appropriated from the General
Fund.
(e) The Secretary of the Budget shall determine the timing
and schedule of payments necessary to effectuate a transfer
required under this section over the course of a fiscal year.
(f) As used in this section, the following words and phrases
shall have the meanings given to them in this subsection unless
the context clearly indicates otherwise:
"Education and general support" shall mean:
(1) Appropriations from the General Fund to a university or
a system of universities that support the education of
undergraduate and graduate students, or the operation of a
university, including funds used to provide any of the
following: instruction, research, public service, academic
support, libraries, student services, institutional support,
operation and maintenance of plants, scholarships and

fellowships and debt service.
(2) The term does not include appropriations for hospitals
affiliated with a university, agricultural extension offices and
services, agriculture research or any grants provided by the
Pennsylvania Higher Education Assistance Agency to students
attending a university or any amount provided for capital
projects financed through the issuance of general obligation
debt.
"State-related institution" shall mean The Pennsylvania State
University, the University of Pittsburgh, Temple University,
Lincoln University and their branch campuses.
Section 2. This act shall take effect July 1, 2022.
