AN ACT
Providing for restrictions on the use of small plastic bottles
by lodging establishments.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Single Use
Plastic Bottle Prevention Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Lodging establishment." A hotel, motel, inn, resort,
guesthouse, hostel, bed and breakfast establishment or building
that is held out by any means as being available to provide
overnight lodging for consideration to individuals seeking
temporary accommodation.
"Personal care product." A product intended to be used on or
applied to the human body in a shower or bath, including any of

the following:
(1) Shampoo.
(2) Hair conditioner.
(3) Bath soap.
"Plastic." Any synthetic material made from organic
polymers, such as polyethylene, polyvinyl chloride or nylon,
that can be molded into a shape while soft and then set into a
rigid or slightly elastic form.
"Sleeping room accommodation." A space in a lodging
establishment set aside for use and occupancy by individuals
having at least one bed or other sleeping accommodation in a
room or group of rooms.
"Small plastic bottle." A plastic bottle or other container
with less than a six-ounce capacity that is intended to be
nonreusable by the end user.
Section 3. Restrictions on use of small plastic bottles.
(a) General rule.--Except as provided under subsection (b),
commencing January 1, 2025, for lodging establishments with more
than 50 sleeping room accommodations, and January 1, 2026, for
lodging establishments with 50 sleeping room accommodations or
less, a lodging establishment may not provide a small plastic
bottle containing a personal care product in a sleeping room
accommodation or in a bathroom shared by guests or the public.
(b) Exception.--A lodging establishment may provide personal
care products in small plastic bottles to a person at no cost,
upon request, at a place other than a sleeping room
accommodation or a bathroom shared by guests or the public.
(c) Bulk dispensers.--A lodging establishment may provide
personal care items in bulk dispensers in a sleeping room
accommodation or in a bathroom shared by guests or the public.

Section 4. Penalties.
A lodging establishment that violates any provision of this
act shall be subject to a civil penalty of $500 for the first
violation and $2,000 for each subsequent violation.
Section 5. Ordinances.
A municipality may enact an ordinance relating to lodging
establishments providing personal care products in small plastic
bottles if the ordinance is at least as stringent as and not in
conflict with this act.
Section 6. Effective date.
This act shall take effect immediately.
