AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in school directors, providing for
liability.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 330. Liability.--(a) A member of a board of school
directors of a school district shall not be personally liable
for civil damages on account of any injury to a person or
property caused by a vote or debate preceding a vote by the
member which is within the scope of the member's office,
provided that nothing in this paragraph shall be construed to
protect that person from suit or liability for any damage, loss,
injury or liability caused by the intentional, willful or wanton

misconduct of that person.
(b) This section shall not be construed to affect the
applicability of an existing statutory or common law privilege
or immunity that offers greater protection to a defendant than
is provided under this section.
(c) This section shall apply to a cause of action that
arises after the effective date of this section.
Section 2. This act shall take effect in 60 days.
