AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in terms and courses of study,
providing for mental health instruction study.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 1555. Mental Health Instruction Study.--(a) The
State Board of Education shall conduct a study regarding the
manner in which instruction in mental health is offered by
school entities in this Commonwealth.
(b) In conducting the study under this section, the State
Board of Education shall request that each school entity provide
the State Board of Education with information concerning whether
the school entity offers instruction in mental health and the
manner in which the instruction is offered.

(c) Each school entity shall provide information to the
State Board of Education in response to a request under this
section.
(d) The following shall apply to the report of the State
Board of Education:
(1) Following the 2020-2021 school year, but not later than
November 30, 2021, the State Board of Education shall issue a
report to the following:
(i) The Governor.
(ii) The Secretary of Education.
(iii) The chairperson and minority chairperson of the
Education Committee of the Senate.
(iv) The chairperson and minority chairperson of the
Education Committee of the House of Representatives.
(2) The report must address the following:
(i) The number of school entities offering instruction in
mental health.
(ii) A description of the manner in which school entities
are offering instruction in mental health, including the number
of hours of instruction offered, the grade levels at which the
instruction is offered, the course within which the instruction
is integrated and the job title of individuals delivering
instruction.
(iii) The recommendations for improvements to the offering
of instruction in mental health, including recommended
legislation.
(e) For purposes of this section, the term "school entity"
shall mean a school district, charter school, regional charter
school, cyber charter school, intermediate unit or area career
and technical school.

Section 2. This act shall take effect in 60 days.
