AN ACT
Providing for marina health and safety.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the James
DeAngelo Marina Health and Safety Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"911 telephone." A telephone that does any of the following:
(1) Allows an individual using the telephone to contact
a public safety answering point by dialing or pressing 911.
(2) Automatically calls a public safety answering point
when an individual picks up the handset and activates the
telephone.

"Appropriate signage." A sign posted in plain view by each
automated external defibrillator, panic button, 911 telephone
and personal security device with instructions for use.
"Automated external defibrillator." A portable device that
uses electric shock to restore a stable heart rhythm to an
individual in cardiac arrest.
"Emergency services." Services, including firefighting, law
enforcement, ambulance and medical services, provided for the
protection or preservation of persons or property in
circumstances of immediate and significant threat of injury or
harm.
"Marina." As follows:
(1) A dock or basin that provides secure moorings for
small boats or pleasure watercraft.
(2) The term includes a clubhouse, building, facility or
other structure that provides food, fueling, repair or other
services for the dock or basin.
"Marine and aquatic services." Services, activities,
privileges or rights offered for sale or provided by a marina.
"Nonstaffed hours." A period during which a marina provides
marine and aquatic services without an employee of the marina on
the premises.
"Public safety answering point." As defined in 35 Pa.C.S. ยง
5302 (relating to definitions).
"Staffed hours." A period during which a marina provides
marine and aquatic services with at least one employee of the
marina on the premises.
Section 3. Duties of marina.
Each marina offering marine and aquatic services during
staffed hours and nonstaffed hours shall:

(1) Meet the requirements of the municipality in which
the marina is located concerning accessibility to emergency
services responders from outside the marina.
(2) Equip the premises of the marina with all of the
following:
(i) At least one automated external defibrillator.
(ii) Appropriate signage.
(iii) A 911 telephone.
(3) Provide instructions regarding the use of the marina
during nonstaffed hours, including the location and use of
all equipment.
Section 4. Effective date.
This act shall take effect in 60 days.
