AN ACT
Amending Title 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in rules of evidence,
further providing for limit on charges.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 6152.1(a) of Title 42 of the Pennsylvania
Consolidated Statutes is amended by adding a paragraph to read:
§ 6152.1. Limit on charges.
(a) Charges.--

(3) Notwithstanding any other provision of law to the
contrary, a health care provider or facility shall provide
without charge one complete copy of a patient's medical
charts and records if all of the following apply:
(i) The patient is a veteran, as defined in 51
Pa.C.S. § 7202 (relating to definitions), and is indigent
and homeless.

(ii) The medical charts and records are being
requested by the patient or a person presenting a valid
authorization for the release of the medical charts and
records that is signed by the patient or the patient's
legally authorized representative.
(iii) The medical charts and records are being
sought for the purpose of supporting a claim for Federal
veterans' disability benefits.

Section 2. This act shall take effect in 60 days.
