AN ACT
Amending the act of October 27, 2014 (P.L.2911, No.191),
entitled "An act providing for prescription drug monitoring;
creating the ABC-MAP Board; establishing the Achieving Better
Care by Monitoring All Prescriptions Program; and providing
for unlawful acts and penalties," further providing for
definitions and for access to prescription information.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 3 of the act of October 27, 2014
(P.L.2911, No.191), known as the Achieving Better Care by
Monitoring All Prescriptions Program (ABC-MAP) Act, is amended
by adding definitions to read:
Section 3. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:

"Insurance administrator." An administrator as defined in

section 1002 of the act of May 17, 1921 (P.L.789, No.285), known
as The Insurance Department Act of 1921.

"Licensed insurer." An insurer as defined in 40 Pa.C.S. ยง
9103 (relating to definitions).

"Managed care plan." A managed care plan as defined in
section 2102 of the act of May 17, 1921 (P.L.682, No.284), known
as The Insurance Company Law of 1921.

Section 2. Section 9(b) of the act is amended by adding a
paragraph to read:
Section 9. Access to prescription information.

(b) Authorized users.--The following individuals may query
the system according to procedures determined by the board and
with the following limitations:

(14) Designated personnel of a managed care plan, a
licensed insurer or an insurance administrator licensed by
the Insurance Department for the purpose of promoting the
health, safety and welfare of members or subscribers,
including identifying drug diversion, misuse, abuse, fraud or
inappropriate prescribing, dispensing, billing or claim
submission patterns in accordance with the quality assurance
and utilization management programs of the managed care plan,
licensed insurer or insurance administrator.

Section 3. This act shall take effect in 60 days.
