AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in reimbursements by Commonwealth and
between school districts, providing for accelerated fair
funding.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 2502.55. Accelerated Fair Funding.--(a) The General
Assembly finds and declares that, to fulfill its duties to
maintain and support a thorough and efficient system of public
education to serve the needs of this Commonwealth under section
14 of Article III of the Constitution of Pennsylvania, the
inequities resulting from not applying the student-weighted
basic education funding formula to all basic education funding
must be corrected by prioritizing new funding for school

districts receiving less than their fair share of State basic
education funding.
(b) Notwithstanding any other provision of this act to the
contrary, for the 2020-2021 school year through the 2030-2031
school year, the lesser of $150,000,000 or the annual positive
change in the amount appropriated for payment of basic education
funding to school districts shall be distributed to school
districts receiving less than their fair share of State basic
education funding.
(c) A school district receiving less than the school
district's fair share shall receive a prorated share of the
amount determined in subsection (b) based upon the share of the
total of the negative differences calculated in subsection (d)
(3).
(d) The process for determining school districts receiving
less than their fair share of State basic education funding
under this section shall be as follows:
(1) For each school district, multiply the product in
section 2502.53(b)(2)(i) by the total amount allocated to school
districts in section 2502.53(b)(1).
(2) For each school district, divide the product in
paragraph (1) by the sum of the products in section 2502.53(b)
(2)(i) for all school districts.
(3) For each school district, subtract the quotient in
paragraph (2) from the school district's allocation in section
2502.53(b)(1).
(e) For purposes of this section, a school district receives
less than the school district's fair share of State basic
education funding if the calculation for the school district
results in a negative difference under subsection (d)(3).
