AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in public indecency, further providing
for the offense of prostitution and related offenses.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 5902(f) of Title 18 of the Pennsylvania
Consolidated Statutes is amended and the section is amended by
adding a subsection to read:
ยง 5902. Prostitution and related offenses.

(e.3) Amnesty for sex workers, sexually exploited children
and victims of human trafficking reporting a crime of
violence.--The following shall apply:
(1) A sex worker, sexually exploited child or victim of
human trafficking who reports to a peace officer or law
enforcement agency that the sex worker, sexually exploited
child or victim of human trafficking is a victim of or a
witness to a crime of violence may not be arrested for the

offense of prostitution under subsection (a) as a result of
reporting the crime of violence.
(2) A law enforcement agency may not publicly release
the name of an individual who is alleged to be a sex worker,
sexually exploited child or victim of human trafficking who
reports being a victim of or witness to a crime of violence
under paragraph (1) without the written permission of the
individual.
(3) As used in this section, the following words and
phrases shall have the meanings given to them in this
paragraph unless the context clearly indicates otherwise:
"Crime of violence." As defined in section 5702
(relating to definitions).
"Peace officer." As defined in section 501 (relating to
definitions).
"Sexually exploited child." As defined in section 3001
(relating to definitions).
"Victim of human trafficking." As defined in section
3001.
(f) Definitions.--As used in this section the following
words and phrases shall have the meanings given to them in this
subsection:
"House of prostitution." Any place where prostitution or
promotion of prostitution is regularly carried on by one person
under the control, management or supervision of another.
"Inmate." A person who engages in prostitution in or through
the agency of a house of prostitution.
"Minor." An individual under 18 years of age.
"Public place." Any place to which the public or any
substantial group thereof has access.

"Sex worker." An individual 18 years of age or older who
negotiates and performs sexual services for remuneration.
"Sexual activity." Includes homosexual and other deviate
sexual relations.
Section 2. This act shall take effect in 60 days.
