AN ACT
Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
act to consolidate, editorially revise, and codify the public
welfare laws of the Commonwealth," in medical assistance,
providing for reimbursement to guardians of older adults.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 13, 1967 (P.L.31, No.21), known
as the Human Services Code, is amended by adding a section to
read:
Section 443.13. Reimbursement to Guardians of Older
Adults.-- The reimbursement rate under the medical assistance
program for a guardian of an older adult as defined in section
103 of the act of November 6, 1987 (P.L.381, No.79), known as
the Older Adults Protective Services Act, shall be increased to
three hundred dollars ($300) per month. The department shall
seek any necessary authorization from the Centers for Medicare
and Medicaid Services of the United States Department of Health

and Human Services to implement the increase of the
reimbursement rate under this section.
Section 2. This act shall take effect in 60 days.
