AN ACT
Amending Title 66 (Public Utilities) of the Pennsylvania
Consolidated Statutes, in rates and distribution systems,
providing for recovery of electric vehicle infrastructure and
gas system expansion costs.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 66 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 1331. Recovery of electric vehicle infrastructure and gas
system expansion costs.
(a) Authority.--
(1) An electric distribution company may petition the
commission to approve the establishment of a charge to
provide for the recovery, on a full and current basis through
a reconcilable adjustment clause under section 1307 (relating
to sliding scale of rates; adjustments), of reasonable and
prudent costs incurred to install electric vehicle charging
infrastructure through an approved long-term plan that

includes collaboration with private industry and has been
deemed in the public interest by the commission. Gross
receipts taxes derived from electric sales through
infrastructure deployed under this section shall be remitted
to the Motor License Fund.
(2) A natural gas distribution company may petition the
commission to approve the establishment of a charge to
provide for the recovery, on a full and current basis,
through a reconcilable adjustment clause under section 1307,
of reasonable and prudent costs incurred for natural gas main
extensions to unserved areas through a long-term plan that
has been deemed in the public interest by the commission. A
petition under this paragraph shall be filed in conjunction
with petitions to modify calculations regarding contributions
in aid of construction and reviewed in whole by the
commission.
(b) Petitions.--
(1) A petition for commission approval of a charge
authorized under this section shall include all of the
following information:
(i) A long-term plan for electric vehicle charging
infrastructure or natural gas system expansion. The plan
shall include, at a minimum, a description of the planned
types, quantities, costs and locations of facilities to
be constructed , a proposed budget and a schedule of
deployment .
(ii) An initial tariff.
(iii) Testimony, affidavits, exhibits or other
evidence that demonstrates that the charge is in the
public interest and will facilitate the economically

feasible installation of vehicle charging infrastructure
and natural gas system growth .
(iv) Any other information sought by the commission
through interrogatory or data request.
(2) No later than 270 days after the filing of a plan,
the commission shall, after notice and opportunity to be
heard, approve, modify or reject the petition, including the
proposed plan, charge and initial tariff.
(c) Limitation.--The costs recovered through charges under
this section may not exceed, on an annual basis, 2.5% of all
total revenues of the electric distribution company or natural
gas distribution company as of December 31 of the preceding
year.
(d) Implementation.--The commission may implement this
section through orders and regulations. The initial
implementation order shall be issued within six months of the
effective date of this section.
(e) Expiration.--This section shall expire December 31,
2032.
Section 2. This act shall take effect in 60 days.
