AN ACT
Amending Title 35 (Health and Safety) of the Pennsylvania
Consolidated Statutes, in public safety, providing for
distribution of COVID-19 vaccine.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 35 of the Pennsylvania Consolidated
Statutes is amended by adding chapter to read:

DISTRIBUTION OF COVID-19 VACCINE
Sec.
5901. Scope of chapter.
5902. Definitions.
5903. Distribution of COVID-19 vaccines to providers.
§ 5901. Scope of chapter.
This chapter relates to the distribution of COVID-19
vaccines.
§ 5902. Definitions.
The following words and phrases when used in this chapter

shall have the meanings given to them in this section unless the
context clearly indicates otherwise:
"COVID-19." The novel coronavirus as identified in the
Governor's proclamation of disaster emergency issued on March 6,
2020, published at 50 Pa.B. 1644 (March 21, 2020).
"COVID-19 vaccine." A vaccine for COVID-19 that has received
emergency use authorization from the United States Food and Drug
Administration.
"Department." The Department of Health of the Commonwealth.
§ 5903 . Distribution of COVID-19 vaccines to providers.
The department shall provide COVID-19 vaccine allocations
available on the effective date of this section to all providers
who received the COVID-19 vaccine during the week of March 18,
2021. Allocations of the COVID-19 vaccine made available after
the effective date of this section shall be made to all
previously utilized providers unless the provider is removed for
cause.
Section 2. This act shall take effect immediately.
